All purchases made through the portal www.laluarquesa.es (hereinafter, the Web), property of PRODUCTOS LA LUARQUESA S.L., are subject to the general conditions contained in the legal notice. The General Conditions prevail subject to the following conditions. By purchasing on the Web, you automatically accept these conditions over the Online Purchase Conditions.

All products and services are subject to the following conditions. By purchasing on the Web, you automatically accept these conditions. Please read them carefully.

These conditions constitute in full what is agreed between the parties in relation to online transactions of sale between PRODUCTOS LA LUARQUESA S.L. and its customers.

PRODUCTOS LA LUARQUESA S.L. is entitled to unilaterally modify each and every one of the obligations set forth in these conditions, without prior notice. Likewise, it is able to restructure, modify or eliminate any information, service or content included in the Web, without prior notice.

A purchase is not final until it is accepted by PRODUCTOS LA LUARQUESA S.L.. PRODUCTOS LA LUARQUESA S.L. reserves the right of admission and cancellation of any order, being able to return the amount paid by the client and being exempt from any other obligation.

The Web does not require prior subscription for simple navigation, access or use of the service in question. On the contrary, for access to certain content and services, prior subscription and its corresponding registration as a User (hereinafter Registered User) will be required.

USER REGISTRATION: In accordance with the provisions above, PRODUCTOS LA LUARQUESA S.L. reserves some of the Services offered through the Web to Registered Users of PRODUCTOS LA LUARQUESA S.L. by completing the corresponding User registration form. To shop online PRODUCTOS LA LUARQUESA S.L. you must register in it. Your data will be saved and your future purchases will be faster.
To register and shop online, you must go to the “Register” section within the “User” section. The User undertakes to select, use and keep his username or “login” and his password (hereinafter and jointly the “Access Codes”) in accordance with the provisions of the following clauses.

ASSIGNMENT OF ACCESS CODES: The User will have the option to choose and indicate their own access password. The User may not choose the Username in any other way than being a valid e-mail address, through which he will communicate with PRODUCTOS LA LUARQUESA S.L.

USE AND CUSTODY: The User undertakes to make lawful and diligent use of the Access Code, as well as not to make his Access Code available to third parties.

The User undertakes to communicate reliably to the Webmaster of PRODUCTOS LA LUARQUESA S.L. as soon as possible, the loss or theft of the Access Codes, as well as any risk of access to them by a third party.

The Access Code may only be used by Users to whom it has been assigned. PRODUCTOS LA LUARQUESA S.L. is exempt from any type of liability that may accrue for damages caused or suffered by fraudulent use or lack of diligence in the custody and custody of the Access Code, loss or use in contravention of the provisions of these Conditions.

PRODUCTS: All products sold on this website are new and original from the manufacturer. The information provided should never be considered complete or exhaustive due to the wide range of products and services available in the sector. PRODUCTOS LA LUARQUESA S.L., for its part, will try to the extent of its possibilities to constantly update the prices of the products by means of a constant communication with suppliers and manufacturers.

PRODUCTOS LA LUARQUESA S.L. states that the product offered usually corresponds to the photograph and technical description of it. However, it is exempt from liability for those cases in which due to technical or human errors there were mistakes or variations between photography, technical description and price. Likewise, it is clear that the photographs have a mere indicative character and there may be variations in terms of their physical appearance but without undermining the integrity and performance of the requested product.

PRODUCTOS LA LUARQUESA S.L. is exempt from the contents, information, opinions or comments disseminated through the Web, nor will it be responsible for the use that the User makes of that information.

PRICE LIST: The price of the products is in EUROS and includes the taxes of Law according to the Spanish Legislation. The final summary of purchase shows the final or total price of the same, indicating the amount corresponding to the price of the determined product and the amount corresponding to the applicable taxes.

Based on its commercial policy, PRODUCTOS LA LUARQUESA S.L. may make final price variations either by loyalty, by acquisition of products of a certain entity or relevance as well as others that PRODUCTOS LA LUARQUESA S.L. may stipulate in due time. However, it will be PRODUCTOS LA LUARQUESA S.L. who freely and voluntarily offers these discounts and / or markdowns, to whom it deems appropriate, not being able to be demanded or requested at any time by the client.

Prices do not include shipping costs. Prices are valid except typing error. All sales are made with their corresponding invoice. Products are available for sale while stocks last.
The prices displayed may be reviewed and modified at any time by PRODUCTOS LA LUARQUESA S.L..

Once the payment has been verified, the processing of the order will begin by PRODUCTOS LA LUARQUESA S.L.

PAYMENT METHODS: Once inside your account you will see your cart and then you must press “Confirm order” and to go to “Shipping and Payment”. The products and services will be paid in advance by credit or debit card, issued in Spain and in which the secure payment systems “MasterCard Secure Code” or “Verified by VISA” have been activated, as appropriate. If you have doubts about how to activate the secure payment system of your card, consult your bank.
Payment by credit card is made through a payment gateway with a secure server offered by La Caixa. At no time, any card data are stored in our database. These data are always processed by the bank.

SHIPPING: PRODUCTOS LA LUARQUESA S.L. will not send any product until the Administration Department has verified that the payment has been made

The delivery will be considered made at the moment in which the carrier has made the products available to the customer and the latter has signed the delivery receipt document. It is up to the customer to verify the products upon receipt and expose all the caveats and claims that may be justified in the delivery receipt document.

PRODUCTOS LA LUARQUESA S.L. will send the products by the means it deems appropriate to fulfill its commitments.

The handling and shipping costs are at customer’s expenses and will be specified in the shopping cart and in the order. These costs may vary depending on the weight and destination chosen by customers. In shipments made to the Canary Islands, Ceuta and Melilla, the expenses include customs costs.

The delivery time will depend on the products and the province to which the shipment is made, and in any case it begins to count since PRODUCTOS LA LUARQUESA S.L. receives the order amount. The delivery of any of the products subject to sale under protection of these general conditions is subject to the availability plan of PRODUCTOS LA LUARQUESA S.L. The latter will make all the efforts to make deliveries on the scheduled date, offered or confirmed. However, they will not acquire responsibility for failures to comply with those dates as long as it is for causes beyond the control of PRODUCTOS LA LUARQUESA S.L..
PRODUCTOS LA LUARQUESA S.L., to offer you fresh and quality products, does not store its products in the factory, but it makes them to order; hence, they have the right to delay the shipment of your purchase until they have made all the products that are in it request. The order will be sent by the means it deems appropriate to comply with its commitments. The cancellation of orders will only be accepted as long as they have not left already from the factory.

Delivery will be completed when the carrier has placed the products available to the customer and the latter has signed the delivery receipt document. It is up to the customer to verify the products upon receipt and expose all the caveats and claims that may be justified in the delivery receipt document.

The merchandise travels to its destination insured at all risk by PRODUCTOS LA LUARQUESA S.L., being the cost of said insurance included in the price relevant to the shipping section.

A copy of the packing slip detailing the merchandise of the complete order accompanies each shipment. The recipient must verify that his order number matches the one on the delivery note. Likewise, the recipient must verify that the number of packages that appears on the delivery document matches the number of packages delivered.

Upon delivery of the goods, the recipient must sign the delivery note giving his conformity to the delivery made. The customer’s conformity on the delivery note implies the waiver of any type of claim or complaint regarding the merchandise ordered and received.

Both to make the insurance effective and to correct any error related to the delivery, it is a must to note in the comments section of the delivery note, any incident regarding the goods received or their packaging. And in case of not being satisfied, DO NOT ACCEPT THE MERCHANDISE. If these are not met conditions, PRODUCTOS LA LUARQUESA S.L. will not assume any responsibility for such goods.

SHIPPING COSTS: A shipping charge will apply depending on the area of selected delivery. Shipping costs to the Canary Islands, Ceuta and Melilla include customs costs. However, PRODUCTOS LA LUARQUESA S.L. RESERVES THE RIGHT TO REQUEST AN ADDITIONAL QUANTITY for especially heavy or bulky orders.
In case this happens and the customer is not interested in formalizing the order with the shipping costs indicated, the amount paid will be refunded and the order will be canceled.
PRODUCTOS LA LUARQUESA S.L. will be exempt from any other commitment or obligation to the customer.

DELIVERY TIME: Generally, an order is sent (leaves our offices to destination) the next business day for those orders for which proof of payment has been sent to us sent before 12:00 noon. If proof of payment is sent after this time, the order will be shipped two business days later. Delivery at destination will be made depending on the area of destiny.
In Peninsular Spain, it will be the business day following the day of shipment. For shipments to
Balearic Islands, the term can be increased by 2 or 3 more days. However, these deadlines are indicative and may vary for reasons beyond our company. PRODUCTS LA LUARQUESA S.L. does not commit to any specific delivery time, since the shipping process depends on third parties.
If a delivery is going to take more than 5 business days, PRODUCTOS LA LUARQUESA S.L. will contact the customer to communicate it and give him the option to cancel the order and receive your money back immediately by bank transfer.

STOCKOUT: On the Web, we only sell products in stock, either in our own warehouse or that of an entity, manufacturer or wholesaler, which allows us to serve the product in the time described as delivery time. However, the synchronization of the Web with warehouses is not instantaneous. In addition, in the period of time between a customer registers an order on the Web until we receive and process the proof of payment, product could be sold out. Therefore, there could be some isolated case in which we cannot serve an order due to lack of stock.

When it is not possible to serve a product due to lack of stock, PRODUCTOS LA LUARQUESA
S.L. will contact the customer to communicate it, cancel the order and return your money immediately by bank transfer.
In these cases, the amount will always be refunded to the customer and the order will be canceled. IT WILL NOT BE POSSIBLE TO KEEP THE PRICE OF THE PRODUCT OUT OF STOCK TO SERVE IT WHEN THE STOCK IS REPLENISHED, since the price of the product changes with each replenishment based on our purchase price.

WARRANTY: The products do not have a warranty if they have begun to be consumed or, if the best-before date is over of what it has been established. PRODUCTOS LA LUARQUESA S.L. is not responsible for the conservation, treatment or distribution that the client or user can give to them once delivered.

RIGHT OF WITHDRAWAL AND RETURNS: The customer may return any product if the delivery of the order occurs in poor condition or with some type of deterioration, or if the order is incorrect, not matching the products received with the order requested by the customer. In this case, it is important to reflect on the delivery note, at the time of the reception of the order, the incident that may have occurred during transport and sign it to be able to make any claim.
In these cases, PRODUCTOS LA LUARQUESA, S.L. will assume the return of the products by the customer and the return costs, provided that the reason for the return is attributable to the company.
Other causes: in order to guarantee the most appropriate hygienic-sanitary conditions for our products, and in compliance with current regulations on withdrawal for perishable foodstuffs, returns will not be accepted for reasons other than set out in the preceding paragraphs.

If you wish to make a return check that you meet all the following requirements before send us the product:
• The product must be accompanied by its original packaging and properly sealed.
• In perishable products, only returns of products that are in poor condition are allowed.
• Returns of perishable products will not be accepted once their original packaging has been broken and consumed part of the merchandise.

If for any reason you are not satisfied with your order, you have a period of 14 calendar days, counting from the date of delivery of the order, to return it, as regulated in article 102 and following the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (TRLDCU).

How to exercise the right of withdrawal: To exercise the right of withdrawal with respect to the products purchased exclusively on the Web, must express their unequivocal decision to withdraw from the contract, within 14 calendar days, in any of the following ways:
· If you choose the option to return the product in any store of PRODUCTOS LA LUARQUESA, S.L., you must previously contact our Customer Service on the phone (+34) 985 64 00 51, or through the email account (laluarquesa@laluarquesa.com) to manifest unequivocally your decision to withdraw from the contract.
· If you choose the option of returning the product through the online store of the Web, you must contact our Customer Service on the phone (+34) 985 64 00 51, or through the email account (laluarquesa@laluarquesa.com) to manifest unequivocally your decision to withdraw from the contract.
· Without prejudice to the provisions of the preceding paragraphs, you may also choose to exercise your right of withdrawal by completing and sending electronically to the email account
(laluarquesa@laluarquesa.com) the withdrawal form, in which case, we will inform you without delay by e-mail the receipt of such withdrawal.

The right of withdrawal will be understood to be exercised within the deadline when you have sent us the communication regarding the exercise of this right before the end of the corresponding period, in the terms indicated above. 

Consequences of withdrawal: In case you exercise the right of withdrawal, we will refund all payments we have received from you, excluding delivery costs without any undue delay and, in any case, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract.
We will proceed to make this refund using the same means of the purchase payment without incurring any expenses as a result of reimbursement with the exception of costs of returning the product. In all cases, the products subject to return must be in perfect condition, in their packaging and with their original label. Otherwise, such withdrawal cannot be exercised.

COMPLAINTS FORM: There are complaint forms available to the client. The form can be requested from our customer service department by phone or by e-mail, and we will send it to the address you indicate. You can also request it in our establishments, in the store of POLIGONO ALMUÑA FASE 2 NAVE 12, 33700 – LUARCA (ASTURIAS).

EXTRAJUDICIAL DISPUTE RESOLUTION (RESOLUTION PROCEDURES): Disputes between the parties that may arise from contracts concluded exclusively electronically may be settled out of court through the online dispute resolution platform published by the European Commission, where you will find all the information necessary to exercise the corresponding actions.
